    Cross-Coll and a "bank's" CC

    Maybe one of you guys has run into this before:

    I'm worried about a CC I got through my bank going after my checking acct. I'm not sure if in the CC agreement there was a cross-coll in the fine print. What's confusing me is I'm getting calls from two different companies (FIA and BofA) both claiming to administrate the CC(collections). Anyone know if that means my bank's CC isn't really through my bank? I'm moving to close the account(checking), but there are two direct deposit's and about 9 direct debits that have to be changed before I can, and all of them are slow.

    Close your account ASAP and move it to another bank that you have no debt with.

    Wells Fargo took over $3500 from me a month ago with no warning whatsoever.

      Absolutely, MOVE your accounts and change all your DDeps and withdrawls.. They are able to take what they need to if you are behind if they have a cross-collateralization OR right to offset in place. It's a lot of hassle I know, but worth it.

        Hi Frogge,

        Thanks for adding your perspective.

        I was a collector 30 years ago when we actually skip traced using reverse directories and I repo'd cars for a while.

        I collected BankAmericard debt (that will tell you how long ago it was) and student loans when they were impossible to collect on because we were collecting many years after a borrower attended college so it was virtually impossibe to find them.

        You are right, you are just doing your job. It's not any easier on us here in the forum but your insights help.

            Hi,

            Why don't you open a new account TODAY and then call the companies that are doing the direct deposit and withdrawls and have them changed to that new account.

            That is what I did when I realized that my bills on a cross-collateral account weren't going to be paid. I opened a new checking and called the companies and FAXED the forms to them that directed the money to be taken from a new account.

                I would change the Direct Dep right now, but I work for the state, so everything runs slowly. It will take at least a month, maybe two, to get it changed. My DW's is much easier. Can they collect on a cross-coll AFTER the automatic stay? I plan on filing in the next two weeks(att already has all of our paperwork, just waiting for him to call back so we can sign), so it might not be a problem at all. Thanks for all your help, lurk here all the time.
