    Just Checked Pacer, a bit confused

    OK, I am a little confused because I just checked Pacer and the UST has concluded my 341 and declared no assets, no money or property received, and no money to be paid to the court. He stated that he has received no property beyond allowed exemptions. He recommended case for discharge and that he be relieved of further duties for my case and that the case be closed following discharge.

    The confusion for me is:
    I have about $8K coming in October from; tax refunds, stimulus, and an Alaska state dividend.
    I have a automobile that is paid off and has about $7K of non-exempt value

    My 45 day redemption time for my auto has come and passed. The UST did not say anything about it. Should I just wait till they ask about it or can I expect the UST Repo-Wrecker to come at 1 am and snatch my truck. Or maybe did they just assume that they would not get much for a full size truck and it wasn't worth their time? The truck's retail value is $11K minus $3750 state exemption. Should I just follow a don't ask don't tell policy and cross my fingers??

    And then comes the tax refunds.....is October (when I file) going to be an early X-Mas?? I can't believe they would walk away from $8K in refunds.
    6/11/08 - Filed Ch. 7, Filed Pro Se, No-Assets
    7/15/08 - 341 Meeting Held
    10/01/08 - Discharged
    10/08/08 - Case officially Closed!!

    They go by the date you filed. If they didn;t say anything about the refund count your blessings. Do not remind them about it. To be safe, don't spend the refund money until your case is discharged just in case they come asking for it later, but if it hasn't been mentioned already you're probably going to be allowed to keep it.
