    Unique situation

    I might need to start first by explaining my background prior to looking at filing bankruptcy. In June 2008 we fell behind in our house payment due to the economy and lack over time for my husbands job. We have been trying to sell our house over the last year knowing we had over extended our selves but as the market started slowing the value kept declining. Seemed hopeless. We also had extenduating circumstances with my 3 children to where my husband and I felt it best for me to quit my job to homeschool my kids. In June we went to look into filing for chapter 7 but our income was just over the allowed amount so we decided to wait a couple of months for the 6 month average to fall below the means test amount. My question is will this look like we are setting our selves up to qualify? Another question is that my husband took a new job recently and we are wanting to move to be in a better location for his job, can we do that before we file or do we need to stay put until everything is finalized?

    It would depend how far the job is.

    You have to attend the 341 meeting, so if moving to another state it might be adviseable to either file now or move and wait 4 months to file.
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      Thank you for your reply. He is driving semi truck for a long haul company, but we live in Vancouver Washington and they have hubs in Nebraska, Wyoming, Arizona and others further east. We are interesed in moving to Wyoming because if we are closer to one of the hubs he will have more home time.
      Did you have any comments in regards to me leaving my job to homeschool my kids?

        I know others on here have left their jobs to homeschool. If any of the problems you have had are documented in some way-- school reports and letters, medical records, etc-- I would keep the documentation in case you needed it. But I don't believe I have ever read of the trustee reaming out a mom that chose to stay home with her kids.
