    Credit Counseling

    Does anybody know if it is a requirement to go through credit counseling before you file bankrupcty? I live in Florida. Thanks.

    From what I've read - under the new law yes, but under this law, no.

      with the latest frauds and scams that come with credit counseling, i don't know why the government would make it mandatory before filing bankruptcy...

        As of right now, its not a requirement. After October 17, you will need to have a consultation with a consumer counseling agency and take a financial management class.

          Even though it is not yet a requirement my wife and I did go to credit counseling (CCCS) before contacting an attorney.

          In retrospect, I suppose I knew deep down inside what the answer would be, but we needed to hear it from someone else, and that is exactly what the counselor told us. He was very nice, not judgemental at all.

          In any event, we filed CH7 and at our 341 the US Trustee showed up because of our high debt load. When we were telling our story, I mentioned that we went to credit counseling before turning to bankruptcy and she seemed happy we did that - in fact she said so.

          Don't know if it helped my case one way or another, but I'm glad we went there first. For one thing, the budget that the credit counselor put together for us was the starting point for our expenses list we put together for CHapter 7.
