    60 Day Almost Here

    8/17/2007 is the magic day! Because the 17th is on Sunday, I would guess that tomorrow is the last day for any of the creditors to file an objection. Hopefully this is the case. At any rate, I have to wait at least until the 31st of August because about a month ago the trusty filed for and was granted a 30 extension. He claims to be looking for assets but as of now he has done nothing. He is looking at the homestead exemption and the retirement fund I have, but here in Texas they are clearly exempt.

          From the way my attorney explained it to me is if the last day to file an objection falls on a weekend or a holiday then the next business day is the last day for an objection. I believe in your case the last day will be Monday the 18th.

            You could very well be correct, but reading the BK codes and such, it says 60 days and says nothing about weekends or holidays. I would think that there would be some wording in the law that would stipulate exactly what should happen if it does fall on a weekend or holiday. Its not that big of a deal because I am more concerned with the trustee nit picking than anything else.

              My attorney also told me if it falls on a weekend then you will have to wait until the next business day.

                    I hate to rain.... you know... but if the trustee filed for and was granted an extension, the last day for objections is now August 31. We had an extension also.
