    Which State do I file in?

    Hello

    I will be filing for C7 soon but do not know which state I need to file in. I have been working and living in South Carolina for the last 6 months while my home in Massachusetts has been for sale for almost 10 months without an offer. I have a small amount of equity in that home which I have a first and second mortgage. I am considering letting it go in BK because of the large expenses. Does anyone know which state I need to file C7 in?

    Most states have BK laws with the verbiage "the better part of 180 days" which means you file in the new state on or after day 91 of residency. You probably need to file in South Carolina, but you should ask an attorney or check with your district's BK court to confirm.

      In your case it is likely you would file in SC but use the MA exemptions or federal if allowed.
