    Which State should I file?

    Greetings!

    I have been stubbornly fighting the need to file bankruptcy for years. Things have gotten pretty bad, Divorce, job market, etc. I wound up moving to another state for work. I've since located a decent job, and have begun paying back the individuals (family and friends) we've borrrowed from.

    Much of our debt is in SC, however, we moved to NH so I could work in the Boston market, which has proven to be a blessing. We are renting in NH but have a home in SC being foreclosed on...we are working a deed in lieu of foreclosure but that is proving too complicated.

    Without going into any more detail, my wife (I've remarried) and I have decided that bankruptcy is my only hope of EVER having a normal life one day.

    I already know that working with an attorney is our best bet but where? Which state should I file or does it matter?

    Any advice would be appreciated.

    It should be filed in the state where you have lived in the most within the past 6months.

      You file in the state where you have resided for the last 91 days. Where the debt was incurred does not matter.

      If you haven't resided in NH for 91 days, you can file in the state where you last resided for at least 91 days.
