    Using credit cards up to filing date?

    I have spent the last three hours reading through the posts. I still have a question unanswered.

    I have been barely making minimum payments for the last several years. I'm 25 and I have $33,280 in unsecured debt. Again, I <i>am</i> making the minimum payments but that is all I can afford. I can barely afford to live on my own and I have been constantly selling things to keep alive. I work part time and right now I only clear like $600 after each bi-weekly paycheck.

    Three credits cards have 5000-6500 owed each. Two have crazy high rates and have been closed for at least two years. One oddly enough has a 6.9% rate but I have been larger payments then using the credit card for purchases hence not going anywhere. Will this account get discharged? Basically, can a CC account get discharged if I even have proof that I was using it to buy necessary items (food,gasoline,...)???

    60days before Oct. 16 is approaching quick. Should I purchase a trip to Puerto Rico tomorrow to just make the 60-day luxery mark?

    I saw that some members said that accounts should be dormant for at least six months and/or I should not make any payments for six months before. I have honestly been making an attempt to pay these folks but I can't do it anymore. It will take me like 20 years to pay them off at the rate I am if I can. To top this all off; I was injured on the job just over a week ago and my employer won't let me work. Big deal- i can get like $487 in workers comp but that is even worse. Who in the hell can live off of that and pay bills? I totally have fallen into a well and no one is around to help.

    Have a free consultation with a lawyer and check out your options.
    By the way - this is no time to take a vacation to Puerto Rico ---you will end up paying it all back....... (considered fraud)

      Even if the purchased trip falls outside the 60 days, you will probably have to pay it back. The 60 day deadline means only the difference between "presumed fraudulent", and having to prove fraud. If the charges were within 60 days of filing, the court will "presume" they are fraudulent, if the charges fall outside the 60 day deadline, the creditor needs to prove the charges were fraudulent (which really isn't that hard to do in bankruptcy court).

        Yeah I won't go on any trips or buy anything I don't need. I think its time to call a lawyer.
