    341 Monday and have a few questions

    My lawyer let me know today she hasn't gotten a single call from the US trustee which she says surprises her since I'm $13K over the median income but all my docs and bank statements show where my money is going. She said the trustee might show up at the 341 and for me to answer the questions and then shut my mouth (I like to ask questions and get details on matters). What questions will they ask? I was told if there were any problems, it would come up *before* the 341, not during or after. Is it a good thing nothing has been asked or am getting setup here? My lawyer is a trustee herself so that is about the only thing keeping me from freaking too much when she tells me she thinks everything is fine and she, as a trustee, wouldn't see anything to object to :-)

    I'm still have one bill collector calling. They even called my parents and told them they were an arbitration company and trying to get in touch with me. Should I call them and tell them off or just wait?

    Thanks, just needed to get those thoughts out.

    And no, I haven't signed up for pacer since I know I'd be on there every evening watching my case.

    I don't blame you about Pacer...I haven't looked either, just because I know I would obsess.

    It sounds to me like you're ok...I hope the 341 goes smoothly for you. As for the creditor who is still calling in violation of the stay, report this to your lawyer and let her handle it..that's partly what you're paying her for..and do it soon to stop the harassment ASAP.

      From most of the people on here who have the misfortune of having to deal with the UST, they (or their lawyer) were contacted before the 341, with a request for additional documentation. That may vary from district to district, but that seems to be the norm in most places.

      We are in a similar boat...we were slightly above median and our lawyer hasn't heard anything from the UST, nor did the UST show up at our 341 on 8/13. He believes this is a good sign and usually means the UST will not get involved

          Yes, this was the case for us. Unfortunately, our attorney "forgot" that the UST sent him an email requesting the documentation so it was a great big surprise at our 341 hearing. At least you know ahead of time that the UST exists and you have a clue that being above median makes their interest in your case more likely. You're better prepared for your 341 than we were. If the attorney for the UST shows up, just stay calm and do as your attorney has said... answer questions honestly and be brief. Good luck - you'll do fine.

            stephenm - I was over 23k, my debt was high(162k) and my attorney told me if the UST had any problems I would hear before my 341. I didn't hear anything before and my 341 went smoothly.
