    Wow.

    Just got a letter from them (Wells fargo) charge off.

    I researched their website and they sound like hard-asses but I am not going to let this scare me.

    Their FAQ talks about how debtors " hyperventilate" after they speak to them and how they say that filing BK is the best thing that could happen to the creditor due to tax laws, blah, blah, blah.

    They write with glee about wage garnishment when there is a possible promotion involved and the debtor is embarrassed.

    They state that they are extremely aggressive. I can't WAIT to speak to them. I assure you that I will not hyperventilate or panic.

    Anyone with any experience with these scumbags?
    Very fortunate in the grand scheme of things but have learned my lesson.

    What do you expect from collectors. 99.9 % of them are probably former convicts, high school dropouts, who can't get a job in the real world.

      Tha scary thing is that they are attorneys.
      Very fortunate in the grand scheme of things but have learned my lesson.

        If they are a legal firm, then you might be prepared to respond if you receive a summons. I currently have a national CC company that sent my account to a local law office. I received their dunning letter (DV'd them and asked for a C&D) and will sit back and see what their next step is. I suspect that given the size of this debt they will proceed with suit and summons. I'll do my best to provide an answer and put them on notice that a default judgment is not in their future.

          Yep, they seem aggressive but I am going to file for BK next week so it will be a moot point.

          Look at their website, they seem particularly aggressive and they are proud of it.

            HBSC sent my account to a collection agency and I sent a cease and desist to this agency because they had contacted my sister in law.

            Then HBSC sent my account to a law firm (Eskanos & Adler---now Mann Bracken) which handles collections. I tried to get debt validation and never received any. I tried to talk to them about my BK but they would not even speak to me because of the previous cease and desist.

            I sent them correspondence about my BK but I guess they didn't believe me because they filed suit. My attorney told me not to worry about it and not to answer the summons, so they got their default judgment. I filed before they could get a writ to garnish wages.

            This was all for about 3K.

            I regret sending that cease and desist but it was at the beginning of the process when I was still scared and ignoring creditors. I believe it is what caused the suit to go forward at such a rapid pace. It was the only cease and desist I sent out of 25 accounts and no one else took drastic action.

              I was contacted by them and I sent them a DV and Cease and Desist, and a letter telling them I was judgment proof a long time ago, and I never heard back from them. So it didn't speed up a lawsuit in my experience with them.

              Could they contact you at work on the phone? Did you own a house? Those are the things they really seem to look for when they try to decide whether to file a lawsuit against someone.
              The world's simplest C & D Letter:
              "I demand that you cease and desist from any communication with me."
              Notice that I never actually mention or acknowledge the debt in my letter.

                I just got my first letter from a collection agency, from Mann Bracken over my HSBC/Direct Merchant's bank account (I owe $6k and some change).

                I agree sending a C&D letter does seem to move the collections up to the next level faster. I don't, however, regret sending the C&D. I've sent C&D's out to all creditors (about 10 so far), HSBC is the only one thus far to refer me to an external collection agency.

                        Most of these collectors will say things like this on their websites... remember, they are selling their services to businesses!

                        I used collectors in my business in the past, and from my experience, they all talked big, but I collected less than $500 in many years of using them. I finally gave up on bothering. It seemed just as many people paid on their own in the end.

                        In my present situation, I have had to deal with a few, most were not too bad (I didn't let it get to the stage where it starts to get nasty, as most of my bills are only about 8 months out.) Also, I did turn the ringer off on my phone. Vonage tracks all of the calls, and it was totally amazing how many calls my number took in a day (over 50 most days).

                        You should be just fine. Have at it!
