    CH 7 Judgement

    I am filing chapter 7. I have a judgement. I am in the process of filling the forms out. I have listed both MBNA and the attorney who filed and was awarded the judgement.

    My question is, do I need to list the judgement? If so how?

    Would they be listed as creditor? Who do I list? The court, MBNA or the attorney? MBNA and the attorney are already listed.

    If I dont list the court, do I send them the discharge when it is final?

    Judgements are a whold different ball game when it comes to BK, and you really need to see an attorney about it. Merely listing a judgment in your petition does not extinguish it. You need to file a "Motion to Avoid the Judgment" in addition to your petition, and as far as I know, there is no publically available sample form for you to go off, you would probably need to go to a law library and look in Colliers Bankruptcy or Norton Bankruptcy Law and Practice 2d. .

        Are these the right forms? Mostly when I search for judgment forms, I get info on judgment liens. What about plain judgments ? What happens after bankruptcy if the judgments are still there after they've been discharged?
