    Is my employer try to pull the wool off of me?

    My employer says that they rec'd a notice to appear in court because they did not complete the 2nd set of garnishment papers that were sent to them, nor did they garnishee my wages, i went to court & filed an objection, which the Judge or court approved. Agreement was made with the creditor to pay $50.00 monthly which i began paying . however the Creditor's attorney keeps going back to the court to refile every 90 days, I got sick of this and what's the sense in me making the payments to the creditor if I have to continue to run back to court ? Last time I was there judge agreed to only an annual review if I agreed to up my payments in July 05 to $100.00, which I agreed upon . In January Garnishment papers were sent again, in the mean time I filed BK, chapt. 13 which was filed on 3-15-05, my attorney advised me stop making any payments to this creditor and I informed by employer of what was going on. My employer rec'd some more papers for garnishment, howver I do not believe that they filled them out . Now supposedly my employer claims that they have rec'd suit papers and that the attorney for the creditor is trying to sue them for the money that I owe the creditor? How can this be possible ? Also my BK case was dismissed, it did not go thru ?

    More than likely, this is another judgement for garnishment since your BK was dismissed. If your employer does not comply with the order, then they can be hauled into court and fined. When you filed, there was only a temporary "stay" on the garnishment...once your case of dismissed - the garnishment could be reinstated. And if your employer does not comply its quite possible they can be fined - maybe sued even.
    HHM or Todd may be able to answer this better than I can.

      I don't know what their interest would be in fooling around with you. Unless they did not file the papers like they were supposed to. I imagine that they are telling the truth. This issue sounds complicated. definitely for HHM or Todd, the big guns!
