I am going to be filing in the next month or so and wanted everyone elses take on this. Heres the situation : I was enrolled at the college for 2 year with loans and federal aid everything was fine my last semester was my internship which i also got federal aid and student loans for. 5 days before my internship the company canceled on me due to change of chiefs which i had used most of the money to settle myself down in the place i was doing my internship which is what it was for. Well time went by and i couldnt get a refund on the rent i had paid in advance (stupid i know) so i couldnt pay the money back it was used as my living expenses until i found a job since the internship would not allow me to start a new one by the time i found and applyed for a new internship. Well they have sent me bills and sent me bills i kept telling them when i get a job i will pay it back but without the degree im not getting a job that pays real well. Instead of sending the federal aid back to the government they sent the loans back and kept the debt as federal aid (map, iasc, feog). Is this the non dischargeable debt that is so dreaded. I have gotten letters from the school saying i owe them and cant get my degree or register anymore until i pay them with threats to sending it to the state. However its been over a year since this has happened i have been working trying to pay for everything and settled for a job below my means just to survive and cant make those payments to them. They want a minimum of $250 a month for 2 years. Heres the thing they havent turned it to the IL state comptroller because i recently got my PERC card and it asks if youve ever defaulted or owe money to a state education university or so. No leins, garnishments, or lawsuits are filed or pending that i am aware of. I dont know if i should go ahead with it or if it would delay my bk if they are found non dischargeable. thank you all in advance for your time.

If the only debt you have are the student loans, which are not dischargeable, what other reason(s) would there be to file? Do you have an a large amount of unsecured debt, like credit cards for example? A large amount of medical bills? Any old debts in collections? If not, filing BK won't be of any good to you. Not to mention, you would not be able to file for several years, if you desperately needed to, and you could end up in worse shape.Bankruptcy History:
