    HELP!! USAA wont quit! can they see phone records?

    USAA (our insurance), which we also have a credit card with that will be included in our BK for which we have set a filling date the second week of October, will not stop at anything!!

    They call my parents, my sister-in-law, brother-in-law, and everyone in between. I can understand my parents because we lived at their home for a brief period of time about 5 years ago, but the others live across the country.

    Ironically, I spoke to both my sister-in-law and brother-in-law yesterday on the phone. They both recieved a phone call from USAA today. Is this legal.

    We were going to file in August but my medical condition prohibited me from doing so since I was under heavy medication for several weeks and unable to do much of anything.

    I am going crazy. I don't want all my family knowing what we are going through, it is bad enough on its own.

    Any suggestions!!

    USAA will continue to call you until you give them a Case Number which you won't have until you have officially filed for BK. USAA continued to call us and we told them many times that we don't have a case number yet. They called everyday. We also told them that we turned in our paperwork to our attorney and were just waiting for a case number and they put us on a 5 day call list (meaning they would call back in five more days for a case number) rather than continuing to call everyday. Our attorney told us that USAA has the right to keep calling until they get that case number from you and that most Credit Card Companies will stop calling when you tell them you filed BK. USAA is just a pest about it.

      Can you still get into your accounts on USAA.com? If so, log into your account and change your personal contact information or delete the phone numbers. I did this before we filed so that they couldn't call me at work.

          If you're using a cell phone with a contract (not a pay as you go cell phone) they can log into your account and find everyone you have called and everyone who has called you. It's illegal, but it happens. This sometimes even happens with landlines. It does not happen with a pay as you go cell phone service like Net10. There is no account to log into.

          But most likely they are simply using software that tells them who your relatives are and who your friends are, and then they call them to harass you.

          It's legal to call relatives ONLY to find your contact information. They know her number already, so they are in violation of the law.

          I would send them a FULL cease and desist communications letter to them by certified mail, and see if the phone calls stop. They probably will stop a few days after they receive your letter in the mail.

          I've found that this method works even with most Original Creditors.

          It's worth a few bucks to find out if it works with them.
