    Time to file?

    I have just over $18K in two CC's. Owe just under $10K on an auto. Am self employed. Business is just barely making it. Although I am making the minimum payments I don't think I can make the CC payments this month or even the next. I've been shuffling payments to my vendors and paying the CC's. so far no problem paying on my car. Divorced a year and a half ago. Wife helped in the biz but she's no longer here. She got the house and I got the biz. The house and an equity line are in my name. Her name is on the deed. The divorce decree said she has till April to get the house in her name or sell it. I really struggling to pay bills. I've looked at debt settlement but that's a nightmare to try and figure out if it'll work to get the two CC's settled. Maybe a Chapter 13? I live with friends and pay nominal rent but contribute to food and such. These CC's are killing me. Any advice at all???

    341 with confirmation recommendation Jan 7/09 100% payback to secured and 10% to unsecured.Plan completed and discharge 02/20/13

    Hi Andyman, Welcome.

    I would pay my vendors before I paid the CCs IMHO. And I would get the XW to change the names on the loans sooner than April. This one could be sticky, it will still look like a transfer and some time would have to go by.

    Some ideas:
    Maybe you could sell the biz?
    Would she want to claim BK too?

    Just some first thoughts. Hang in there.

      I can't sell the biz...it's all I know and at 57 I'd have a hard time finding a job. Plus the biz is (hopefully) going to be my retirement if I can sell it in 7 years or so. I don't think the ex wants to file. She's making the house payment and the equity line payment. I've got a call in to my attorney to see if he can help. thanks for the reply!
