Question regarding B of A Visa Card >>

I took out a $23,000.00 cash advance back in Sept 07, have paid all payments, over the minimum payments until the last 60 days or so, just unable to afford the minimum payments.

Question is this... has anyone thats had a B of A cc not be hassled by them? I have only been contacted by B of A 4-5 times in the last 60+ days.

I told them that I cannot afford more than $250 a month, was advised that the minimum amount due was a payment program for 5 yrs that works out to be around $550 a month, can't do it!

Is B of A getting ready to sue? I just do not know what is going on and am very affraid to contact them......

I took out the large cash advance and lost the money on a trip to Las Vegas, am anticipating on filing in the upcoming months here......

Will B of A try and get a judgement against me right away?

Will the bk courts have more mercy on people that are now filing bk since the Govt has now bailed out the banks with our tax money??

    Thanks!

It is exceedingly rare for original creditors to sue. It does happen, but more common is that the account gets charged off 6 months after the initial default and it is turned over to a collecion agency or debt buyer.

As far as BK, so long as you kept up the minimum payments for 6 months, you will be fine.

BOA was actually one of my easier creditors with which to deal. They offered me a 10 cents on the dollar settlement within 3 months.

Chase sued me for and got a judgment in record time.

When I stopped sending payments I sent and certified letter advising B of A not to contact me at work, maybe they thought I meant no contact at all....

Anyone have an idea of how much they would settle almost $30K for?

Mine is 33,000, and as I said, 10 cents on the dollar. Friend of mine had 37,000 and same offer. She took it. I haven't figured out what I am doing yet.

Mesa777, I am sorry, but, you have other problems. To lose that kind of money gambling, Bk will set you free. Will you stop? PLEASE, say you will.
If I knew it all, would I be here?? Hang in there = Retained attorney 8-06, Filed 12-28-07, Discharge 8-13-08, Finally CLOSED 11-3-09, 3-31-10 AP Dismissed, Informed by incompetent lawyer of CLOSED status, October 14, 2010.
