    Getting Audited....help

    Hi everyone, I got a letter is the mail today and the UST is performing an audit... Just my luck. They are asking for 2 years of cc statements, 2 years ultities bills, transportation expense proof, like gas and tolls, etc. lease agreements on vehicles, etc. is this normal? I am a no asset case BK7. The letter says they are reviewing for ABUSE... What do they mean by that? My case was basically cut and dry, mosting all CC debt. SHould I be worried? And what are they looking to do? Everytime, we turn the corner its a different obstacle. Is this normal?

    Oh, I'm so sorry to hear that, Jesse. The audits are supposed to be random, although depending on the trustee it could be truly random or triggered by some suspicion of fraud. I seem to remember that you were way over median? That's probably what attracted attention, and they just want to be sure your deductions are kosher. If your case is pretty simple and you've kept decent records (and your attorney knows what he's doing), you probably don't have much to worry about - it's just a huge annoyance. Good luck.

      Sorry Jesse. I am sure you will do fine though it is a royal pain! Hang in there! I have seen a few people post here that got through that same ordeal.

        I have a problem, cause I do not have 24 months of credit card statements or utilities bills either. What do I do? Do you think the CC companies will work with me?

          Jesse, I am so sorry. Who in the world keeps two years worth of credit card statements or 2 years of utility bills. Once I pay the bill(s) it get's shredded. Jerks.. I would expect something like this if someones running a business.

              My lawyer is pissing me off. I called there today and the paralegal won't get on the phone, they leave me holding and then the secretary somes on and says make an appointment. I say for what? I have a few questions and need answers now. SO she says email her. I did, but needless to say, they didn't answer. It the same old story, they are great and always take your call, ut as soon as you pay in full, they blow you off... I am soooo feedup.. Make head feels like is is going to explode. Who the hell keeps copies of cc statements and utilities for that long. I am a terrible record keeper, but I mean give me a break 2 years!!!

                Jesse deep breath Give your lawyer a chance to respond I know that's easy for me to say but you will get the email back.
                are any of your online accounts still working? try that.

                  TEW - No i went online all of them say call customer service and then when i call they say you have to have your attorney contact us.

                    Jesse, so sorry to hear of all the bs you are having to go through.

                    I guess we can all learn from this.I guess we should always assume that the UST or possibly others may want outdated documents. I would say for those who are planning on filing or still have active accounts should download statements from as far back as possible for any and all accounts.Save all receipts even if they are filed in a shoe box.Plan for you BK if at all possible.And the attorney you have should be a little more attentive to his clients needs....what a jerk...Good Luck Please let us know how it goes.

                      are you over the mean income for your state??

                      Just because you pass the means test on paper it doesn't guarantee you. If you are over the mean you will have to prove all your expenses to the UST.
                      Otherwise his job is to push you into a Chapter 13.

                        Personally I think that audits of bankruptcy filings will increase dramatically especially for filers who were lucky enough to have Chapter 7s discharged.
                        While this is not necessarily a part of the "bailout" plan, it would let me to believe that these audits would probably result in cases being converted to 13s where hard-up creditors would at least be partially repaid.
                        We, the consumers are not being bailed out, the banks are.

                          magyar - you are right! they bail out the banks and then us comsumers who don't have a pot to piss in have to worry...

                          Exactly what is abuse? Everything on my petition is real, nothing made up and no lies, I have nothing to hide, but now i cannot produce the 24 months of credit card statements and they also want me to prove that our transportation eexpenses, which I have not kept my gas receipts or tolls receipts. I didn't think i had to, my lawyer never said they COULD ask for this stuff, so make sure you keep all receipts.

                          I am sick with worry. Worry about what? I am worried about the uncertain. Now, will the US Trustee be at my 341 too? Also, explain to me what is abuse. Thanks
