    Had my 341 meeting today

    I had my 341 meeting today. Figured I would let you know how it went.

    First, I am not at all happy with my lawyer. She did not call, was not reachable at all before the meeting. I hadn't talked with her in a month or more, and tried to reach her all morning. I eventually went on my own, showed up an hour and a half early. She ended up showing up 10 minutes before the meeting. She told me one or two things - basically handed me my copy of the papers, told me to have my liscense and SS card ready, and that was bout it. After words I asked how it went, she said "Oh, she's not interested in your case" and that is it. Final. Probably never talk to her again.

    Anyway, it was not help in the courthouse, but in what amounted to a conference room in an office tower. There was a little waiting area outside, plus more inside. Most people waited in the outside room at first, unsure about going in until enough lawyers told people they could come in and watch. Chairs are lined up like a conference, and the partys sit up at a table in the fron of the room.

    The Trustee in this case, I discovered, was a lawyer herself. She was not terribly threatening, even tried to make small talk to the people in otder to calm them down. he trsutee meeting was pretty much like my lawyer meeting. It's not a type of thing where she seemed to be trying to dig up dirt on people - it was more a case of making sure everything is filled out right and everything is abiding by the rules. The only people I saw who came to say anything were business bankruptcies - I did not see any other creditors there.

    She asked some basic questions - have you ever owned real estate, have you ever received any trusts, do you have anything you cancollect on, does anybody owe you money. She did ask everyone when was the last time they used their credit cards. Again, it was less a case (at least with her) of her trying to weed out money as to make sure everything was filled out properly. There were a couple of Pro Se cases - she did not like those - told them their paperwork was filled out wrong and made them get a lawyer and continued the case. I hate to say this, but it is obvious they do not like the pro se filers.

    Oh, the clothing issue - a few people showed up in jeans and tee shirts, several people in shorts. The only people in suits were the lawyers, and honestly I think if anyone else did show up they would be looked at pretty questionably by the trustee. Even some of the lawyers were not wearing suits or ties.

    Other than that, I think it went OK. Now I am just waiting for this to get over with so I can get on with my life...

    My lawyer did not get with me before my 341 either. I don't think any of them do unless you call them with a question. My 341 was 2 hrs. away from my town so my lawyer just paid another law firm to have someone sit in on the 341. This other law firm didn't introduce themselves to me or any others that they represented. The trustee is an attorney so that's normal with everyone's case I think. On the dress code issue, my 341 was the same way...very casual. It sounds like your 341 was about the same as mine. Glad everything went well.

      Well I am curious to know if those pro se filers hand filled in the paper work. I swear the form7.com software is unbeatable. Fills in everything you need, transfers things to other pages if necessary. And looks VERY professional.

      I did have a paralegal look my mom's over. Part of me wanting to do that was so the paralegal would add her "stamp" on there. So any trustee would know that a "professional" at least looked at them. But she didn't do that. I think the form7 software will save many headaches for the pro se filer. I am SO glad I found information about it here!

      Sounds like you meeting went well. Did you wear the tie or not.. ?? I am dying to know!

        I think my atty must be one in a million. He only charged me $500 + the filing fee. He called me right after he filed the petition to tell me when the 341 was set. He called me the day before the 341 to remind me to come, what to bring and gave me his cell phone # in case I needed him. He was also there waiting for me at the 341, talked to me ahead of time telling me what the trustee would ask and then talked to me afterwards again, telling me that it went great and I should get my discharge paperwork in 60 days or so. I really feel blessed after I hear all of these horror stories. I tell everyone who is thinking about bk to go to him. I'm in SC if you were wondering.

          Sounds like you did end up with a good one! I tried to contact mine, but she never returned my calls.

          I did not wear the tie. Had slacks and a button down shirt.

          For a couple of the Pro Se clients she chastied htem on what they put down. I will admit I think they probably did not do a good job, but she really seemed to want to go after them. A couple of them you could watch walk out - they were not doing well. They said how hard it is to afford an attourney - I really think these attorneys forget these people filling have no money at all. It becomes a game to them, and the forget how devistating it is on the filers.
