    Car & Tax Refund

    We live in Florida and are considering filing bankruptcy but have a couple questions. I am unemployed, actually trying to get a home business going. My wife is working outside the home. We don't own a home, we are renting. About the only assets that we have are our car, computer, and furniture.

    Our car (99 Nissan Altima) is worth about $6,500. Will we lose our car if we file bankruptcy?

    Also, we have a sizable income tax refund ($8,000) coming in the next few weeks from several years taxes. Will we lose this refund if we file bankruptcy; i.e. will the court take it? This refund could really help us to get back on our feet.

    Anything that we can do to keep from losing our car and this tax refund?

    p.s. Forgot to mention that the car is paid for.

    Hi,

    Your refund could be used as a viable means to make good on some of your debts. It is unlikely that you'd lose your car. If you're concerned about the refund and are serious about filing for BK. Then just stop paying your debts, and file for BK 90 days after your recieve your refund check.
