    Please, I need advice

    Hello,
    Earlier this year my live in boyfriend decided to stop helping me pay the bills. We bought the house together, but it's in my name alone. He was taking his checks and just blowing them. We could barely get by on both our income combined, so when he stopped helping, I couldnt pay the bills. Our relationship was miserable so i left. I started renting a little house, scared and confused. I couldnt afford anything so I started using my credit cards. I basicly had to start all over. I didnt know how I was going to pay the debt back, but i didnt have a choice at the time. Now here I am a few months later with credit card bills pouring in and I just can not keep paying on them anymore. I need to file bankruptcy. I am afraid they will think I planned this whole thing, and never intended on paying on the credit cards. I am a 58 year old woman, who has always had very good credit. I hit a rough patch in my life and didnt know what to do. I dont have a car payment. I dont have any real assets. Im losing my house. My life seems like a whirlwind. Could someone just tell me If they think I will be OK to file bankruptcy. How long should I wait? I racked up all my debt about 3 months ago. I am afraid Im going to go to jail for fraud, when that was never my intentions. Someone please help, im scared.

    I think you will be fine, from what I have been reading you may need to wait a few more months to hit the 6 month mark..but not sure.
    You will not go to jail. I don't think any of us intended to file bk. You did what you needed to do to survive and now you need to make a "business" decision to survive. Just look at it that way, you will be okay.

    It is very scary but talk to a good attny and read this forum. My husband and I were very stressed and we religously read this forum and got really good advice and insight that we did feel better, more in control.

      Stay calm.

      Basically to assess your bk ability need a bit more info.

      However on the surface it sounds like you are a good candidate.

      Ideally it is best to wait 90 days after the last use of the credit card, however this is not a hard and fast rule.

      Is he still living in the house? I assume so since you are renting.

      Stop paying the CC and stop using them. Obviously you can't afford to pay them. Make sure to pay your rent, food, gas etc. Save any extra towards a lawyer if you can.

      How much have you grossed in the last 6 months?
      May 31st, 2007: Petition Filed by my lawyer
      July 2nd, 2007: 341 Meeting Held
      September 4th, 2007: Discharged and Closed.
