    need new tires

    Hello all,
    I have no money and i need new tires on my truck. I have a Goodyear card I can use,but I sincerely would not be able to pay it back. If i go ahead with the purchase and file in about 2 months,can i be in trouble. If so whats the worst that can happen. thanks

    Can you make some payment on the card after you buy the tires? If so that would look a little less like fraud. If you use a CC with out intention to repay Have you spoken to an attorney yet?

      If I knew it all, would I be here?? Hang in there = Retained attorney 8-06, Filed 12-28-07, Discharge 8-13-08, Finally CLOSED 11-3-09, 3-31-10 AP Dismissed, Informed by incompetent lawyer of CLOSED status, October 14, 2010.

        Yes, if you purchase the tires, make one minimum payment and file two months later...it would fly right through. I did something similar with some dental work that HAD to be done and I don't feel bad about it b/c it was medically neccessary at the time. If you feel that your vehile is unsafe for you and others on the road because of the bald tires, I would do it. I would not drive my children in an unsafe car. But, I would not just purchase new tires because you want them. Being a need, and considering the financial situation, I would be inclined to do it.

          We charged 4 tires on our Goodyear card 2 weeks before filing. The total amount charged was around $600. We never made one payment to them.

          Goodyear never came after us...if they wanted, they could have their tires back.

            One more point, if it was for necessary living expenses 90 days prior to filing you should be fine. You need tires for your vehicle to get to and from work=necessary living expense. (Emergency medical and dental work are also considered necessary)The creditor would have to argue that you intended fraud to buy luxury goods. Tires are not a luxury. Now if you were to buy some real kickin' rims to go with the tires...

            You should be fine, don't buy the rims!

            Worse that can happen is that you would still owe the debt for the tires after your discharge. Your chances are very high that this will not happen.
