    what about my LLC

    I plan to file chapter 7 for myself personally. Part of the money I owe is a 25k Home Depot credit card I took out about a year ago in the name of my llc, of which I am the sole member. I also personally guaranteed this card. It is the only debt my llc has ( the llc has no assets either ). Do I need to file separately for the llc? What happens when I stop paying this? Should i close the llc?

      No. My business venture didnt go very well. How would I close that anyway?

        Your lawyer will know how to list this debt on your personal Bk schedules. Obviously, if you stop paying, they will look to you, not the LLC.

          I would file personally and include the LLC debts. Sometimes when there is a fine line of intermingled assets and debts, we will file both the personal and the business at the same time. In your case, this shouldn't be an issue.
