    Question on bank balance on day of filing

    Just need a little clarification as usual... We file Oct. 22. Our bank works a day behind online as far as what the balance is...i.e. today it would list yesterdays balance. I think the ATM is stamped with today's date as far as what the balance is. Would that be acceptable??? I can't think of any other choice.

    All help is appreciated...trying to stay sane here.

    Call the bank on the morning of Oct 22 and say "What is my balance as of this minute?" Use that dollar amount. When you get your bank statement it should coincide with this.

      You can do it the old fashioned way - go to the bank see a teller have her/him print out the balance in the account on letterhead. See if you can geet them to sign and date it too. Do this on the date you file because the trustee does ask for the actual balance as of that date. That way you have a written record.

        The trustee will also ask for the bank statements. Be sure that these numbers match. In our district, a printout as of the date of filing means nothing to a trustee, they want the actual monthly bank statement to match up with the amount you put on your petition.
        Just do everything in your power to make sure the numbers match.

          Our trustee didn't ask for either our bank statements or our balance on the day we filed. None of the trustees here did during the nearly 100 341's I witnessed that day (we were last to be seen). Doesn't mean they don't ask in your area, but check with your attorney before stressing too much about it. That's what I did because I did find myself stressing after I read on here about possibly needing those things. He said no worries and he was right.

            Bank accounts information/balance usually becomes current in the morning hours. Banks run the previous days' credits and debits at night. By 6 a.m. the following morning you can view an up to date balance of the account.
            On the other hand that morning's balance may be different if you have outstanding checks that haven't cleared yet. Best way to deal with that issue is to take that morning's printout and your check register with you.

              As you can see I am brand new to all of this so I am trying to learn as much as possible.
              When you file how far back will anyone want to see your bank statements or do they just ask for the one that is most current? Thanks

                It is the very first thing the trustees asks for in our area. They scrutinize it with a fine tooth comb. Like you said it would depend on the area, but if the trustee is doing their job, they would check to make sure they are at least close.

                For the last post...
                The trustee can request up to two years of statements but they usually don't unless if they suspect you are hiding something. The local rules in Minnesota allows the trustee to go back up to 6 years but I have never seen them do that.
                The one they will most likely want to see at the 341 meeting is the one that includes the date of filing.

                  Wow..up to 6 years?

                  I am in the middle of a divorce that has been going on for 2 years now. I have yet to see a single penny from my husband. So since I have no money I have sold my great grandmother's jewlery to raise money to pay for the bankruptcy lawyer. Now I am worried that if they go through my bank acount and see a larger than usual deposit that I will get into trouble.

                    How much was the deposit? Was it the money to pay the attorney? How long ago was it?

                      Thank you for your reply.

                      I deposited $4700.00 into my account which will pay for the lawyer and my mortgage and misc other bills like car etc. I depostited it yesterday which there is a 11 day hold on it since I did not have the funds in my account to cover it.
