    Lots of cash advances

    Hello,
    I'm going to file bk soon. I have $150,000 in cc , $45,000 in lines of credit $690,000 mortgage .I have not worked in 2 months. I have been living off my cc with cash advances, and from my lines of credit. I have been using the money to support a bad drug habit. This drug habit has cost me everything. Can they put me in jail? I don't have any more money to pay anything back. What do they do in a case like this?

    Im sorry to hear your story. Are you still using? If so I think thats the first thing you need to work on..if you cant kick your addiction your not going to beable to work , pay your utilities, rent, basic needs. Get some help and get under control then your head will be clearer to figure out what comes next. JMHO...

      I'm sorry to hear your story. Just my opinion, but perhaps you need to take things one step at a time. If you aren't in recovery, get yourself to rehab, it will be a lot cheaper in the long run than supporting a drug habit, not to mention healthier. Getting a financial fresh start won't mean anything if you are still in active addiction.

      1. Call a friend, doctor, pastor, insurance company if you have, someone to GET HELP.

      2. If you have any credit left, use it for REHAB/help!

      3. Once you are clean and sober, then look into working on the collateral damage (relationships,finances) of your drug addiction.

      To answer our question:

      Can they put me in jail?
      No, I doubt you will get jail time, but if you have cash advances more than $700 (I'm not sure on the exact amount) less than 70 days before filing, there is a presumption of fraud and your petition for BK will be dismissed and you will not be aloud to file again. They won't put you in jail, but you will miss your chance at a clean financial start.

      Put as mush time between filing and using your credit as you can. Using your credit for something like rehab won't look nearly as "bad" as continuing to get cash advances directly into a bank account.

        I echo the thoughts of the previous 2 posters. You need to get help immediately, your financial situation is something you can address when you're clean, but until then it's a secondary problem. You're more likely to get jail time for using drugs than for the financial problems you now face. Take time for yourself and do what you need to do, call a friend, find rehab, connect with your family, those are the important things.
