    can a trustee analyze exempt assests?

    I have been reading through threads today and I just saw a potential problem some people are going through...for example a trustee filed a motion for potential assets on someones ch 7 case and wanted to look into their exempt assets.

    Our lawyer said that CA has a 21k wildcard exemption combined with homestead and that the trustee wont even look at or ask about that and that we shouldnt worry. is this true?

    The Trustee can do about anything he wishes. If he feels like an exemption was made in bad faith, he can come and look. I doubt he will, and we sure had a ton of problems with preferential payments and other things, but our Trustee never gave us a problem when he could have caused a dismissal. We all worked out a compromise. I have to pay twice on a thing.
