I feel like the wind is sucked out of me...went to the lawyer to file and after thinking we were going ch7, found out our disposable income pushed us into ch 13... to fill you in...DH has retirement income only and I am on SS disability. But the schedule I and J ended up with disposable income...mine I guess...when I questioned the lawyer about it being exempt...he said it doesn't matter...kinda disposable income is disposable income.
He adjusted the schedules as best he could for this area...but we still will pay 908 and that includes out vehicle.

The good side is that we passed the means test so we can do 36 months instead of 60 . I realize that we are disposing alot of debt and am sooo grateful for that. Just a shock thinking of going from 7 to 13.

Any comments are greatly appreciated!!

I think you will be fine! I'm sorry that you are being forced into a 13 when you wanted a 7. I am below the means test, but I wouldn't have qualified for a 7 either... Good luck. It kind of rocks being in a 36 month plan though. I think it will go fast for you. These past 3 months have kind of flown by.

I talked to three attorneys that all said that I would have to go 13. The forth attorney said he could make a 7 work for me. Guess What? Discharged as a 7 on 10/20/2008. You may want to talk to another attorney or two.

i agree with flameout, i met with a couple lawyers who felt i would have to go with a 13, then a third who said he could get me a 7. i think its always best to get at least a second opinion. granted, everybodys case is different but the consultations usually are free so it can't hurt.

Also met with three attorneys. Ch 13 was it for us according to the first two, were filing Ch 7 with number 3. Hopefully it works out!

It took more than one attorney to find one who'd consider a 7 for me. So ditto!

hang in there. This too shall pass and you will be much better for the experience. Lifestyle changes are tough. At least the BK will keep the phone silent while you make the adjustments

Thanks everyone for your replies...I do know this all happened for a reason...just not quite what I had planned...but if I had planned in the beginning I wouldn't be in this mess now!!

So it's an opportunity for change and for us to get it together never to be here again...always have to learn the hard way.
