So I email my lawyer today to see if it were a problem me buying a new car. I'm probably a month away from filing as I have two more payments for her. I also let her know today that I had upped my income a little bit to around 45k before 7k from my roommate.
When I met with her in April I gave her two recent paystubs in which I was grossing 1600-1700 and netting 1150 and she made copies of them. Well she emails me back today thinking I may be forced into a 13 because I may now make too much as she thought 1150 was my gross salary not net. She then attempted to cover herself by saying that she would have to look at it all and get back to me once I got her all my paystubs.
So I wrote her an email saying how did you think I gross 1150 when you have a couple copies of my paystubs from April? I told her I was going to be really pissed if I was forced into a 13 at this point, cuz I would've done things differently and just bought this car no matter what. So now I'm freaking out, obviously I don't want to do a 13. For those of you that are in 13, how bad is it? Also, how do you do the means test. It was always my impression you take what you have gross, which for me would be about 4400 (including roommate) and then take after taxes and everything and then calculate your expenses within reason or IRS standards and that's how you get your amount. After all my taxes, 401k, and what not I have a 1300 every two weeks and then 600 from a roommate a month. If I am forced into a 13 how do they calculate your payment.
This is what I have a month:
First Mtg: 891
Second Mtg: 383
Association Fees: 182
Comcast (3-1): 150
Gas: 137
Elect: 62
Car Insurance: 78
contribution to company car: 200
Property taxes: 400
Student Loan: 62
National deductions for food and groceries: 507
Entertainment: 50
That leaves no money for gas or anything else, how does that force me into a 13?
