    Hello again...I have several questions...after filing I received another acct that went to collections (was sold). Can I just call them with the case # and my attorneys number?

    Also after reviewing all the paper work ( we didn't get a copy till AFTER it was filed...not happy about that...we got the copy to take home.

    Anyhow, on one creditor which was a private loan from a friend, instead of it being listed as $20,000...it was listed at $2000.

    My question is could this affect my ch 13 payment and make it go up?? Is what you pay back based on a % of total debt??

    Also, we are keeping our car and have never been late, etc...yet they are having us pay the car inside the ch 13...it's really our only asset.

    When I checked pacer it said CH 13 asset.

    Any help.advice is greatly appreciated!!

    all chapter 13's are considered asset. So that should not worry you at all. Yes you can add the creditor so they can be notified. You could mention the error on the personal loan to your attorney but your friend will file a claim for the amount you owe. Your friend will be paid the same percentage as all other unsecured creditors.

    The order of payments would be
    1. attorney
    2. priority secured (such as IRS, vehicle, mortgage payments etc) My trustee paid off my car befor any unsecured creditors received a dime.
    3. unsecured.

    IMHO it won't change your payments, it might help keep your percentage to all unsecured's lower. And not all creditors will file a claim.
