Why do they want my husband's info if I'm filing alone?

    Why do they want my husband's info if I'm filing alone?

    I am, at this point in time, planning to file a Chapter 13 in my name only. Yesterday I picked up the packet that the attorney requires I fill out prior to the free consultation. They want to know everything - and this includes my husband's SSN, accounts that are his, and so on. If I would be filing ALONE, why do they need that info?

    I don't particularly want to provide his personal information, lest it somehow get included if we proceed.

    Thank you for any information you can give.

    They want to know how much he contributes to your finances...what he may pay for you, what part of the mortgage, credit cards, utilities, food, etc...

    In their view, they need to know what YOUR actual expenses are, so they have to take his into consideration to make that evaluation.

    Any financial contributions from anyone in your household has to be considered.

    That's the short answer to your question.

      As Ephiphany stated, it's because it's your husband, he lives with you and contributes financially to the household which includes your expenses.

        I filed in just my name - but since my husband and I live together - they take his income into consideration.

        HE didn't file for BK - and it never showed up on anything of his... we were VERY Careful to make sure that nothing of his was included in the BK. None of the CC's that were in HIS name were included. It did show up on a joint vehicle - but we didn't have any problem with it, and it's not on his credit report today.


        Now - that being said - MY BK was because my EX husband ran up almost $700,000 in debt almost 10 years AFTER we were divorced, and my name was on some of that debt. He then disappeared. I was easy to find, had a responsible job, and was an easy "target" for the creditors.

        My new husband and I had very little debt of our own... some - but it was "managable"... until the EX's crap hit...

        but - I digress...

        The courts will determine your payments based on your joint income, your joint expenses, your joint family needs... etc.... even if YOU file alone. Also - you can't get a divorce without the courts approval - at least not here... I thought about that too!
