    Questioning mortgage on credit report after discharge

    Our Chapter 7 bankruptcy was discharged in Jan 08 and tonight I just checked one of my credit reports. It shows that our mortgage from Chase was included in the bankruptcy. I knew that we reaffirmed that debt with them, looked at our paperwork, and we did. Here is the full story:
    We had been paying our mortgage payments and were current through April 08. My husband had lost his job last Nov. and we contacted Chase to lower our payments as we had an ARM. They finally got back to us at the end of May. By this time my husband has found a job in a different state, meaning we would have to move. Chase had quit sending us monthly statements, except in July when the payment lowered. I paid the July payment, and then didn't receive anything from them until the end of Aug when we received papers from a lawyer's office about a notice of stay (or something like that). I called them to find out why we weren't receiving statements/bills from them and they said they couldn't contact us because of the bankruptcy. My lawyer said that they should be sending bills because it was discharged in Jan. In Sept they finally sent us a statement stating it was for informational purposes only and if we chose to make a payment to use the stub below. We paid Oct, the amt that was stated. Last week we received papers about Acceleration Notice with intent to foreclose. I keep arguing that we received no "bills" from them, how were we supposed to "pay" them. I keep getting the run-around from Chase about not being able to contact us because of the bankruptcy, etc. Yesterday we received from Chase a "bill/statement" with all of the late charges and past due amts on it. And then this on the credit report. I am really confused as to what is going on and need help/advise. I will be contacting my lawyer in the morning but just wondered if anyone else has had this happen.

    When you file BK, you have to list all your debts and therefore listed your mortgage company. Your mortgage company is notified of that at that time. Even though you reaffirmed, it is still actually part of your bankruptcy as they were listed in your filing. Everyone usually goes through this with their mortgage on their credit report and it is correct (it was part of the bankruptcy). Sometimes if you dispute it they will change it if all payments were made on time and nothing late; however, it seems you have issues as to other problems so you will need to get it all straightened out and I see you plan on contacting your attorney.
