    Disability Question

    My understanding is that retirement benefits are excluded from your income in calculating Bankruptcy income. Is this true?
    I am receiving disability income from my employer which were part of our pension plan, are they included?
    My disability pension is currently $24,000 per year, but next April 1st it will go down to $16,000 per year. How can I reflect that? Will they take that into account if i file now? Thanks

    My understanding is that you list all your income....but I am new to all this too.

      No, its not true. Any source of income is a source of income for bankruptcy purposes. I have posted on this elsewhere, so I won't go into detail here. But there is a distinction between disability "the asset" and disability as "income".

      The "asset" of disabiliyt is your right to recieve the disability income, and that is exempt. However, the "income" of disability is a factor in determining your disposable income.
