    Negative Reporting while waiting for discharge

    Hi all I filed BK CHP 7 in April and I have received my discharge in July, I am now reviewing my credit report and it does not show anywhere that I have filed bankruptcy on any of the accounts.

    As a matter of fact I am still receiveing negative reporting from the same companies I placed on my bk application.

    Are they still suppose to be reporting?

    I have negative reporting from companies on my bankruptcy application that were reporting will I was waiting for my discharge. Please let me know if this is something they are allowed to do and whether or not I can do anything about it.

    You need to dispute them with the credit reporting agencies - they're going to need a copy of your bankruptcy. Keep on them! It shouldn't be there!

        Well only one company has reported " included in bankruptcy" everyone else is saying late pay with dates as recent as 7/28/2005. I was discharged on July 12. Some were reporting in June aswell, some creditors say collection/chargeoff , subject has not satified debt. Some are still reporting late pays of 30 , 60, 90 days. I thought they were not to make any collection attempts or negative reporting.

          do not send them a copy of the bankruptcy

          i repeat do not send them a copy of the bankruptcy...its incriminating. instead go get a good credit repair law firm and let them do the disputing for u. Trust me i had great results. Some things that are wrong maybe be deleted instead of included in bankruptcy. u want deletions. it makes the credit score rise.

            how is it incriminating to send the credit agencies/creditors a copy of your bankruptcy? Also, by going to a "credit repair law firm", that's just more money that you have to cough up for them to fix it.

            Go to the credit bureaus directly..........and dispute your findings. They HAVE to correct those marks........and free of charge.

              yes it is incriminating

              it is incriminating... by me using the law firm credit repair 2 of the bureaus no longer even show my bankruptcy.... half of my accounts are deleted from the bureau. This is something u wont be able to do individually, cause u dont know legal jargon. so i mean u take your choice bankruptcy showing or bankruptcy deleted, and a 720 credit score 8 months out of discharge. Money well spent

                Although you have deleted your BR from 2 of your reports, just know that it is in public file, and it will show back up in a few months. It is because they were not able to find the time to doublecheck. But as the public record reporting continues it will come back. Believe me it will.

                I think it is great your score is 720 9 months after discharge. But most people are better with the accounts reported as O included in BK then getting them deleted and then coming back on. I am an attorney, and I have seen it happen. People pay big bucks to clean up credit, and then in a few months the accounts come back on, that were originally deleted.

                  ok...........so, again, how is it incriminating sending the credit bureaus/creditors a copy of your bankruptcy to get your credit reflected right with the creditors???? Most, if not all, people on here do not have the money to shell out to another law firm after filing bankruptcy and already have paid out money to a bankruptcy attorney.

                  I don't get where you come up with it being incriminating.

                    I don't think it's incriminating at all - it's what my lawyer said would happen if this situation came up in my case. He said you want to start pulling credit reports a couple months after filing - if it's reported wrong I may have to send in a copy of the bankruptcy.

                    I think if you found a firm to do that - that's great ... but I'm not convinced it's a permanent fix - keep us informed about it throughout the next couple of months, if it does work, it's something I'd like to look into over the next year.

                      A BK may reappeaer in your file. Public records are checked on a rotating basis by the CRA's. The point is to get the report to reflect accurate information and not get flagged by the CRA's for just trying to remove everything negative. You need to address the issue as such:

                      Credit Reporting is a form of an attempt to collect a debt.
                      Therefore they are not allowed to report late payments after you have filed. They are allowed to report included in BK.

                      Having the BK removed changes nothing. The Public Record lasts twenty, not ten years or seven. EVERY application asks have you ever filed BK? You are legally obligated to say "yes" for that time (like first time homeowner is considered to be seven years after your first home was sold or foreclosed). Why take steps to repeat behaviour that can lead to another problem. The point of a BK is to uncomplicate things.

                      Try to worry more about saving for awhile and don't stress out with this CRA mess. Tme will take care of it. If you are going to clean a file do your work right now, TODAY, while some businesses may down because of the Hurricane. it is going to cause some disruption and may work top your advantage.

                      Since my BK I did refinance my home @6.9%. I have spent hundreds of hours online and driven cross country once (FL. to Tn. to AZ.) and been able to secure hard assets. I even bought some commercial property in a distress sale (1.5 acres on I-40 at an exit). I had to finance only one Parcel out of four and did that at low interest. I'm not passing this road again EVER again. The utter HELL with credit. I have been cleaning my file slowly and my report seems to hover at 630 on all three. It will come up with time but i don't want any Credit right now, I'm enjoying using cash!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

                        Yep on the CASH......

                        I may keep a cc for emergencies only, but its cash again for me....

                        And my credit score is back up in the 700's again even though I've been discharged, but case is still open......

                        Yes you need to start disputing your credit report...

                        Why pay someone else? When you can do it yourself?

                          Amen to that Minny. I have checked my credit report with all three agencies and already begun to dispute entries. Of the three Trans Union seems to have the most errors; specifically, they list several companies on my report I never heard of. I am taking advantage of the free credit reports and thanks to you guys I know what to look for, what is allowed and how to dispute the entries. Let me also chime in on hiring someone to "remove" entries. I work for the Better Business Bureau and we have received a number of calls from consumers who used a service or law firm to do just that and like a previous post said, they are BACK on the report. If it worked for her..fine but it is not the norm. Besides I would rather do it myself anyway. On a more serious note we all need to pray for all the people who live(d) in New Orleans and Mississippi. I lived in Baton Rouge for a long time and we had several hurricanes "pass over" but nothing compared to Katrina. My heart breaks for those people and a lot of friends here in Tennessee are sending money, baby food, diapers, etc. Despite the looters(and they will pay) the majority of people are opening their hearts and wallets to help. God Bless them...
