    President Elect Obama - Congratulations - Please Amend The Bankruptcy Code

    President Elect Barack Obama made many promises along the campaign trail. The most important in my view was the promise to change the Bankruptcy Laws. The bankruptcy laws must be changed to stabilize the housing market. By changing the bankruptcy laws, President Obama will probably create an avalanche of bankruptcy filings; but, he will be credited with saving hundreds of thousands of homes. Why is this the most important topic on his agenda? That is an excellent question.If you think about it, President Elect Obama will be facing the toughest agenda of any U.S. President that I can recall. He will be facing catastrophic international and domestic issues, as well as astronomical budget deficits. Personally, I cannot understand why he would want the job; however, that is not relevant.

    President Obama ran on a platform of change, and that promise is what swept him into the White House. He promised to change the United States and the World. Of course, this is a tall order, but not impossible.The American people have put our trust in him. Americans have been tattered and lied to by past administrations, but we are still Americans. As Americans, we will triumph by putting our best foot forward, working harder than ever before, and accept the changes that are in store for us. But, the President Elect must settle things down in the United States first, before he can take on the international scene.

    The President Elect must change the bankruptcy laws to help the very same people who helped him get elected. He must help them save their homes from foreclosure. The Bush administration passed three (3) pieces of legislation that did nothing to save any homes. In October 2008, bankruptcy filings were up 40%. Many of my clients are surrendering homes that may be able to be saved.

    So, President Elect Obama, Congratulation on your historic win. Once you are in office, you will have the opportunity to change many things in this Great Country. I’m sure they all appear to be priorities right now, and in their own ways are priorities; however, you need to protect the sanctity of the American home. You need to give families the security of knowing that they will have a place to go at the end of the day. You need to let them know that you care, and that you listened to their concerns. You need to amend the bankruptcy code to stem the tidal wave of foreclosures, and allow people to go forward and deal with their mortgage companies and creditors in a neutral forum.

    Should - but won't. Remember Biden was one of the few Democratic supporters of the bill in 2005. Delaware bankers lined his pocket.

      There are a lot of things that should be done as to the BK Code and all credit and lending regulations. There is no magic wand to fix this mess and it is going to take a while. Also, they have to be careful of all the other Joe & Jane Plumbers, Joe & Jane SixPacks, etc. out there that work hard, work 2-3 jobs, pay their mortgages and bills on time; that those folks don't end up rebelling over all the bailouts and freebies/cuts given to others that they can't take advantage of or get relief for their burdens. Tough situation...

        Now, Debt Education Institutions should/must be built first. Make it a standard/mandatory class, course or education requirements in all HS and college level curriculum! (for all people over 16 !

        Then, America will wake up and smell a Free, strong flavor Star Bucks coffee ... (like da one I got for voting Obama) on his election day!

          Agreed. I'm amazed that there is no mandatory education on the use of credit and money management. I took tons of useless classes in college, and the one I could have used most is a lesson on credit and how the cc industry works. It may not have made any difference as most of mine and my husband's debt came from circumstances beyond our control, but it might have made me think twice about buying new clothes or video games that we thought we needed.

            Far more important then anything else tought in any school at this time. Just ask the poor student loan debtor with huge outstanding loans being paid for with a low paying job.

            Debt education by itself would have prevented this from happening.

              Good idea - if basic reading/writing/math classes are passed first. THere is a large % of kids who graduate without knowing the basics.

                    It all starts in the home; my parents did not sit down with me and go over finances. My mother was a housewife who did a heck of a lot of volunteer work for our church and a few societies/clubs they belonged to and my dad always holed up at his desk to do the bills always shooing me away if I approached and asked him what he was doing or to show me what he was doing. Everything was always taken care of for my sister and I. I knew I would change things when I had kids and I did; when they earned their first paychecks I sat down with them with the paystub and went over the various deductions and why they were withheld. They learned to save as we did but as we all know we never save enough nor plan well enough. My hubby and I made great money for several years never thinking we would ever end up having to file BK and just purchased all sorts of stuff for us, kids and family/friends, just going way overboard at times. Well, when the money stops it all comes crashing to a halt if you cannot recover and replace the lost wages. That was just poor planning and spending on our part and a bad assumption thinking we would never end up having to file BK.

                    Now that most of us have gone through, are in or are contemplating filing or just maybe dealing with bad credit due to this economy, whever the reason talk to your kids - sit down with them and teach a budget and how to deal with what goes in and what has to go out. If we instill good habits from our mistakes and our knowledge from going through all this, our children will learn.

                      Got a nice ring to it. Whatever course anyone word come up with won't stop the problem for most, but what you said has a nice touch.

                        I think they should wipe the slate clean for everyone and start all over again. That's the only way to end this financial crisis.
