    How long

    does a person have to wait before they can file bankruptcy again? I had head it was seven years, but then I'd heard five and ten? Just wondering!

    It depends what type you would file, ch7, ch13 and this too is changing under the new law. No more so called "chapter 20". (ch7 + ch13)

      Also, it depends on what chapter you filed before.

      Technically, you can file bankruptcy as often as you want, however, you just don't receive a discharge in all circumstances.

      In order to receive a discharge in a chapter 7, you must wait at least 6 years from the date you filed your previous chapter 7.

      Chapter 13 you can pretty much file anytime you want.

      There are some more in's and out's as to when you can file, you should probably see a lawyer if you really need to file to find out for certiain.

        Right now, you are eligible for chapter 7 if your last chapter 7 was filed more than 6 years ago. So, if you filed 9/2/99 or earlier, you're good. After the new laws take effect, the 6 year rule changes to 8 years.

        I don't know about chapter 13, but I believe the time between will increase with the new rules as well.
        Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.
