    Filed, but now have situation I'm worried about....help

    Hello, back on July 13th me and my wife filed for chapter 7 bankruptcy. On August 16th we had our meeting with the trustee. A problem occured when the trustee realized she knew me from having taught her son, resulting in a conflict of interest. My new date for the trustee meeting is scheduled for September 28th. Yesterday I accepted a job (8/30) and am worried about how this is going to affect my bankruptcy. Can anybody give me some advice. Thanks

    Are you making more money? Are your expenses still going to check out?

    I wish I could lend more advice - I would hope that it wouldn't affect it too much!

      If the job change is going to create extra income, you need to bring this too your lawyers attention so he can notify the trustee of income changes. If its about the same, no problem probably...
      If it changes your income drastically (excess income) you may be forced into a Chapter 13 instead of Chapter 7....

        Thanks for the quick replies. The job will create excess income. I was receiving unemployment when we filed and this job pays more. I'll keep you posted, my lawyer is supposed to call me tonight.

              Yeah, don't worry about it. Anything earned after the date you filed is yours.

                ANDOLINI,

                James had to attend a different 341 meeting with another Trustee because the Trustee that had been appointed to him "knew him" previously. This creates a conflict of interests with the court.
                So the court appoints another Trustee to handle the case that is unknown to the debtor....

                  Exactly right minnymouth, the trustee was a parent of a student at the school I was at. Once I was asked where I was employed and anwered her question she immdiately stopped the meeting and said there was a conflict of interest. Thanks for all the comments

                    That is an interesting conflict of interest. Maybe trustees have different conflict guidelines, but I honestly don't think its a conflict of interest. If you are not teaching the trustee's kid now, what is really the problem

                    Anyway, good luck, it will only mean you case last longer than average.

                      I thought that was a little extreme case of "conflict of interest" too. I mean, we meet/see so many people in our lives, the chances of knowing one of them somewhere down the line is pretty good. :s

                      Also, you might have more income now, but you should have more expenses too.. don't forget travel expenses and work clothes, and lunches.. don't know if you'll need any of that, but it's something to keep in mind?!

                        With the cost of gas these days, remember to factor that in... Getting to & from work ads up! (I use $40-50/gas each week, just driving to & from work.)

                        Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.
