I have sat here for a while and I thought it would be nice for someone to detail there experience and what they are going through for the new people. I will probably update this one a week to give people an insight of exactly what is going on, ups and downs
Up to this date, I have done countless hours of research on bankruptcy and really figuring if it is right for you. As many of you already know, it is really two sided(Counseling tell you how bad bankruptcy is and lawyers tell you how great it ends up being) I would say about 75% of the stuff on the net is garbage. I have noticed from the lawyers that I have talked to over the phone that they are interested in the $650-$800 that they are going to charge you before being interested in yourself.
My experience starts with the plain fact of having enough. I want this debt away and the simple fact that I will not be able to pay it off within 3-4 years has lead me to bankruptcy, especially with the new law changing. I was unemployed from November 04 to March 05, currently working as a temp until October 05 and then will be unemployed again.
My finances are somewhat straight forward. 15k in CC debt within 5 cards, 16k in Student loan debt that I pay, another 25k in Student loan debt in my name that my dad pays. I live at home and have zero assets. Most of my problem is from playing the horses, which I have ceased. As for the credit cards, 1 is at an attorney, 1 is at a collection agency, and the 3 are still at the credit card company
I went to see my lawyer last weekend and it was a sureal experience. I got there at 9:45am for a 10am meeting and didn't get to see him until 10:30am. While I could tell that he has done this numerous times, it felt very computerized and like it was going through the motions. All in all, he felt my situation was fairly straight forward and I would have no problem filing Chapter 7. Like any situation like this, after I left I could think of 5-6 questions that I had to have answered. The questions that you have no answers to is the worst part about all of this. I am lucky to have established contact a couple times with a paralegal there that has been really quick and understanding of the situation and has answered all the questions that I have.
Right now, nothing more will get done until I pay the attorney in full, $859 is for everything. While I could have done this myself, I could only imagine how crazy I would be if I were doing it. Next update will be after I pay the attorney, hope this helps.
