    Emergency Petition?

    Can anyone tell me more about this? I've seen it referenced in a few places, but don't know what it is.

    Is it something simple that can get the process started to stop garnishment activity?
    Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

    An emergency petition is the first two pages of a petition along with the schedule of creditors and creditors mailing matrix. Generally it is used to envoke the automatic stay to stop some collection activity, like foreclosure or garnishment.

    Once you file the emergency petition, you have 15 days to complete the remaining petition schedules or your case is dismissed.
