    Primary Financial Services - lol

    So this is a funny one. Wells Fargo, after about 6 months of not paying on 2 business credit cards, has turned the accounts over the Primary Financial Services...anyone heard of them?

    Call went like this:
    Them: Mr. XXX
    Me: Yes.
    Them: This is xxx from Primary Financial Services. Our "firm" has been hired by Wells Fargo regarding you business credit cards.
    Me: Your "Firm"? Are you a law firm or a collection agency?
    Them: Our firm has been hired to resolve this matter.
    Me: Again....are you a law firm or a collection agency?
    Them: Collection agency.
    Me: Then fire me off a letter and I will review. I do not discuss financial matters over the phone.
    Them: I don't like your attitude.
    Me: Excuse me?
    Them: If you do not want to cooperate, I will advise my client to file suit against you.
    Me: At this time, I must advise you that this call is being recorded. If you are threatening a suit against me, than you have violated the FDCRA.
    Them: I did not threaten a suit, I simply stated that I would advise my client to file suit.
    Me: Sounded like a threat of suit to me.
    Them: Trust me Mr. XXX, a suit will be forthcoming and I assure you this is not a threat, but a promise.
    Me: You should see the suit that I will prepare today against your company in the mail in the next week or so.

    Click.
    Yah...probably not enought to tag them with a violation, but it sure was funny.

      This company sounds like several other collection agencies out there now. I believe more and more folks are educating themselves of their rights, and once you ask for them to send you written information as required by the FDCPA, and are not willing to share "anything else until you have reviewed the written documentation," the ball is really no longer in their court.

      I doubt that the CA will send back the word to sue you. What does the CA get out of this? Unless the CA is also a legal office, then I doubt they would be the ones suing. I do suspect you will see something written.

      United Collections Bureau called me on an alleged debt and threatened "an asset search." They did this after I requested written documentation. I think they were just frustrated and wanted to say more (probably from some script.) I recorded every call and voice mail message and told them so. They called another 5 - 6 times and kept explaining to them that I was still waiting for the written information. At one point they told me it had been sent out on the "6th," another caller said the "10th," and another caller stated a completely different day. I recorded all of this. I'm not all that interested in filing FDCPA suits, but it didin't take long for this CA to rack possible violations. "Threats, false/misleading statements, etc." I've recently listed all the violations and will just send a complaint. I just put together my dispute of alleged debt letter and included a cease and desist.

      You probably add a bit of "shelf-life" to your file when you exercise your rights. LOL

        This is a local Phoenix, Arizona collection agency. They called my previous employer and asked him all sorts of questions about me, and they told him he had to answer them. He just laughed at them and said some *expletives* and hung up on them.

        I sent them a cease and desist letter years ago, and have never heard from them again. They're all attitude and all bark, but no bite.
        The world's simplest C & D Letter:
        "I demand that you cease and desist from any communication with me."
        Notice that I never actually mention or acknowledge the debt in my letter.
