I lost my job last month and I am going to be getting some money next month and at that time I will have enough money to pay my bills for a few months but my problem is this month. I cannot pay any of my bills this month and I am worried about my mortgage. I will be coming up on my second month late and also my payment to my BK. It will be almost a month late also. I am going to pay all of this and get caught up on my mortgage completely in January. How will the bk courts and my lawyer look at this situation? All help would be greatly appreciated.

Are you bk7 or 13. Before all, notify your trustee of your late pay and intent on paying next month. I would notify your mortgage holder as well. It is always better to tell them before they tell you. 'HubIf I knew it all, would I be here?? I'm sure it depends on the trustee, nothing is the same across the board. In Oct I was $500 short on the bk payment. I wrote a note to the trustee,said it was a "temporary budgeting problem" and I expected to get caught up by Nov. 1. Well, it took another month but I'm caught up, and haven't heard anything from the trustee. At least not directly, haven't checked on Data13 site.
So yes, keep in touch with trustee and attny., much better than them thinking you're ignoring them or blowing them off.Good luck to you; this is not an easy process.
