    Bank filed a lawsuit- how long? HELP!

    Hi all,

    Need some advice, cheering up...

    One of my creditors filed a lawsuit in November 26 (about 2-weeks ago). I have not been served yet. How long before I need to before judgment? Also, preparing for BK, but need another month or two (ideally), should I panic and file now?

    BTW, the judgment is for a little over 200 dollars, court costs, etc.

    In Dallas, Texas.

    One of my creditors filed two suits against me... One in November 2007 and one in February 2008... neither have made it to court to get a judgment against me as of yet. Just file an answer and it will drag out farther.

      If they haven't sued you yet you have time to file.

        What is the process? For example:
        1. you stop paying?
        2. they send you letters?
        3. they sue you?
        4. they file judgment?
        5. you file bk?

        Just what is the process? I also live in Texas

          Texas is a non-garnishment state, correct? For $200, I doubt they are going to go after a lien on your property, but even if they do, you have time. I would let the process play out, maybe file a request for a new date to stall a bit, and then file BK as planned, which will stop the whole process.

          Plan Modified July 8, 2009 from $1100/month to $400/month due to change in income, finally discharged in July of 2013!

            Mintz see your pm's, You really don't want a Judgment if you can help it. For $200 no doubt it is small claims Court. You must appear in any case. You can agree to pay that pittance and it would be prudent to do so as the trouble you will have is worth stopping it for 200 bucks. 'Hub
