    Is this true?

    I called my attorney who was not in and I spoke to her paralegal today and I wanted to discuss a possible switch from Chapter 13 to a 7 as I feel that saving my house might not be the best thing and out of nowhere she tells me that I cant switch because of a divorce that I had 10 years ago!

    Is this true?

    I wanted more info on why and she said that my atty would call me back later this week.

    I live here in Tucson, AZ by the way.

    I can't imagine that a 10 year old divorce would do that to you. Remember that is not a real lawyer. They make more money on a 13 than 7. You must talk to your lawyer or get a second opinon. 'Hub

      Yes, I think they are trying to pull a fast one on me since a chapter 13 brings them more money. The paralegal said that I could walk a way from the house but that I would still be in a chapter 13.

      I'm thinking about going to see one of those legal aid counselors for some more info.

        Was the house part of the decree? Does your ex-spouse retain an interest? Or is there a DSO in your Chapter 13 that would not be dischargeable under a 7? That may be the concern.
        Filing for parents: Dad w/ dementia, mother working at 71, 3 special needs g'kids
        Rental property equity: $100,000, Consumer debt: $120,000
        First meeting with attorney 12/16/08
        Upshot: 60 mo plan, ~80% payback, rentals to trust & mom retires!

          Me and the ex have been annulled now for over 10 years so I'm not sure why this would affect me.
