    UST has 10 days from 341 hearing....

    If I'm reading this right, the UST has 10 days from the original 341 hearing to file presumed abuse. If my 341 hearing was continued to January, the 10 days is from the 12/11 date not the 1/6 date, right?

    We have provided the UST with everything they've requested, answered all their questions and haven't heard anything else, so I hoping I won't hear anything until after the 10 days. We did have 2 BT that we did back in June/July (yeah I know, why didn't I find this forum before we filed?) so that is our concern. But we can show where the monies went--we certainly didn't just cash some checks and make off with the cash.
    11/18/08 filed CH 7; 341: 12/11/09, cont'd to 01/06/09
    03/21/09 341 hearing for CH 13
    04/27/09 Confirmation hearing for CH 13
    $199/mth for 60 months + $9K 2008 income tax refund

    They can file an extension, so no the 10 day rule does not always apply. In fact if your 341 is continued then it is very likely they'd get an extension as well.
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      a date they have to file the extension by? or they can file an extension on day 59 if they like?

        So my attorney would get notice of the extension, would it be in PACER or would I get a notice in the mail too?

        Just wondering in case it occurs.

          Most often the extension does not appear within the 10 day frame on PACER try not to overly worry about it. So long as you have honestly completed your application you should pass through the process with little problems.
