    My Lawyer Died!!

    Well I have 3 months left on my Ch 13 BK. It is a 60 month term. I got notice that my lawyer died recently and to pick up my file. He was a 1 man operation so there is no one to take over his cases.

    I am close to the end of my BK. What do I do? Do I need to hire another lawyer. Do I need one for the discharge? I have been timely with all of my payments both to trustee and mortgage company.

    I don't think this close to the end of your Plan you will need to obtain another attorney. Call the Trustee's assistant or Clerk of Court at the BK Court and see if there is anything you need to do to ensure things go through smoothly for the next few months as they well should. When you make your last payment, contact your Trustee's office that you are doing so and you will/should receive correspondence and further information from the Trustee as to the discharge of your Plan and what should be taking place.

    Our attorney after our discharge sent us a marvelous letter indicating what might occur after BK. Since your attorney is deceased, after your discharge if any of the creditors listed in your BK and discharged in your BK attempt to collect on any of the debt discharged in your BK, contact another lawyer immediately.

      Thanks for the advice. I called my trustees office and was told the same thing. I can't believe I'm only 3 months away from the end. PHEWW

        I know...it's been a long hard road and I congratulate you on keeping your mortgage and plan payments on time because that will work to your benefit in the months/years to come.

          Thanks. You know, I think that BK may have been the best thing that ever happened to me. Before the BK, I spent money without thinking. On whatever caught my eye. After I filed life was tough, no going out, no shopping, no cable, nothing. I was bare bones. But I learned the value of cash. Every penny I spend I put thought into. I'm a cash only girl from now on. I have since gotten a job that pays twice what I made when I filed but I live on the same budget I did when I filed. I have a savings account for the first time ever. Last year I bought a new (used of course) car with cash. I never thought I would be able to do that in my life. BK taught me fiscal responsibility and I am so glad. My only outstanding debt now, besides my mortgage are my student loans. Once those are gone that will be it for me.
