Ok, so we went to see the attorney and all went extremely well. She told us to go online and complete the cccs and that they would email her the certificate showing that we completed it. I must say the whole thing was a bunch of stuff we already knew. It took about 45 min for us to complete because they wanted a list of everything. They made me chat with them 3 times about how things were going, but that was it. Was this really nessesary?

I really think that the credit counseling that we get is not what the government intended when that requirement was put in. I think it is the most watered down version that they can give you and really serves us no purpose. I recieved BOTH of the required counseling in the beginning. I must say that the one that the trustee gave us was MUCH more helpful than the pre-filing stuff.

It is because it's a requirement for filing. No matter how ridiculous you may feel it is, it has to be done. Not doing it will cause your case to be dismissed. It's the same way with the post filing course too. There was a lot of stuff I already knew, but I took the 2 hour course.
It's either do it or deal with the creditors hounding you and possible lawsuits. Which would you rather have?sigpic

You are exactly right.
It is up to us a BK filers to find the right budget for us post BK and the right type of financial advice. It does seem ridiculous that the BK mandated education is just a money making farce for CCCS (and others like it) - rather than the help it was intended to be at the time of BAPCA.Filed CH 7 9/30/2008

I am not an attorney. None of my advice is legal advice in any way..

CCCS existed long before the 2005 BK reform made it mandatory for filers to undergo the counseling process. It's primary purpose was (and still is) to explore possible alternatives to bankruptcy. It is somewhat ludicrous to require debtors who have already decided to file to have to go through with this process - but it is not entirely without merit.
In my case, CCCS proposed a payment alternative to bankruptcy which I could never afford. They said I could preserve some credit privileges if I paid them $1900 per month for 4 years. As it is, I am paying my Chapter 13 trustee $311 per month for 54 months.

Just did my credit counseling today and had to call in in order to get the certificate. The guy asked "did you find it helpful?" I said "uh, I guess." He said: "well, you don't sound convinced." To which I said "well, it was a bunch of stuff I already knew. However, if you'd like the number to the President of the bank that let me go a year ago, that got me into this mess, I'd be happy to provide it. I guarantee he needs this education more than I do."
