    What would you do?

    Right now Im living in the house I will be surrendering in my chapter 7, of which was filed 12-22-08. I havent paid taxes in 2 years because I couldnt afford to, and I havent made a mortgage payment since 8-08. Strangely, I havent received any foreclosure notices <yet>!

    I know at some point I will have to move. I found a rental today, a beautiful house, right in the neighborhood I was hoping for.

    Would you stay in the house you were surrendering, for free (no mortgage payment, right) until you were kicked out? Or would you be proactive and find a place?

    Im torn because its really exactly what I was hoping for. But I really enjoy living "rent free" right now. I just dont want it to come down to the 11th hour and get kicked out and have to settle for something crappy. Advice?

          Only my opinion, at this time, houses and rentals are dime a dozen. Stay and say no more. Be as quiet as you can and put that money towards a future rental, you know, first, last, security and all that. Only my opinion. 'Hub

            My vote is to stay for free as long as you can. If they haven't even started your foreclosure you have many more months to live rent free.

            We own (2) rentals that we are surrendering and the last payment we made on them was 9/08. We haven't heard a single thing about foreclosure either.

            Right now, since you have filed, you are protected under the automatic stay. You won't be discharged until end of March. Then the bank can start the foreclosure, which will take several more months

                Stay - unless it's costing you money (ex: the water faucets all leak and water bill is high or the house is extrememly hard to heat/cool due to bad insulation/windows.)

                Depending on where you live, it will take a long time for them to send the forclosure notice.... then even more time added on until they make you move out. It took over a year for them to forclose and "evict" (we moved already) us.

                Main reason we wanted to move was the leaking faucet and toilet that constantly ran (we tried to fix to no avail), the fact that it cost so much to heat and cool, and also, the cost of gas going up making our commute cost so much.

                If you can stay then by all means do it! Just make sure that you are not blowing all the extra money on needless things and save it up.

                  Thanks for the advice... I think I will stay. Its going to be hard though.. the house is exactly what I need. BUT I will wait - its not meant to be obviously.
