    Help with Mortgage Reaffirmation!!!

    #2
Since you are re-affirming the original mortgage with the company - they cannot list it as "included in BK" because it is not. You are paying them as pre-planned.....they are listed as a creditor with the intend of continuing payment with them
If they report otherwise - its fraudlent reporting. You can force them to change their report or be fined.

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.

Do you have any legal links or information to back up this information. I ask because I have been in personal contact with the bankruptcy department for my mortgage company. They tell me all I want to hear but cannot offer any written proof my reporting will be positive if I keep my account current.

On another forum, I have read posts where people have reaffirmed their mortgage only to find that it is listed as "Included in Bankruptcy/Reaffirmed". This might be acceptable if I were to receive the positive reporting of the current payments, high credit/current balance, etc.

How can I guarantee my positive reporting before I sign to give up my rights?
