    preparing packet for lawyer-questions

    I'm finally about to start filling out our packet for the lawyer that lists all our debts. Many of of credit cards have now been turned over to collection agencies. And to be honest I've lost track of which agency has which debt. So should I list the original creditors or do I need to pull credit reports for both myself and my husband and put only the collection agencies down. Or do I put down both the original creditor and the collection agencies?

    One more question, if I'm going to owe taxes for 08, I'm guessing I need to file those 1st before filing the BK so the payments to the IRS can be included or can they be added later? I already owe and am making payments for the last 2 years, which my attry said would be paid off in the plan. (I know, this is bad, I have to make major withholding changes this coming year).

    Yes, pull your credit report and make sure all of your creditors are listed in your matrix. Include the original creditor and the collection agency. You want both creditors to receive the letter from attorney about you filing, this also enforces the automatic stay if they come after you. Of course this applies to chapter 7. Since your Chapter 13, I don't know how they distinguish payments to the creditor (original versus the CA).

    As far as the Taxes. I assume you would need to file so you know exactly how much you owe and the amount that will be paid out.

    Hopefully some of the CH13 people can chime in.

      If you do a search on here as to creditor listing question in Chapter 13, you will find a ton of help and information. Pull your credit reports; match up your original creditor with the collection agency and list both on your paperwork with a note next to each that they are one and the same. Your attorney will take it from there. Do not list the address to which payments were sent - find the correspondence or bankruptcy address which is listed on the creditor's website, the paperwork you received when you obtained the credit or on the back of a recent statement.

      Your 2008 taxes have to be filed before any amount owing can be included in your Chapter 13 and you will need to turn copies of those documents over to your attorney (state and federal) so they can be included if you do end up owing taxes.
