    CH7: HELP Last day before discharge, creditor files claiming fraud

    Need some help here..
    None of my other creditors came behind me..

    About 2 years back I started a biz with a partner and we borrowed some money from another person. The business lost money and we shut down over one year back. Now the partner is claiming fraud since I was running the business and is trying to over turn my entire ch 7 based on one of the debts that I had with him (5k) and another debt that we both signed off on together.

    Honestly, no fraud was committed. Towards the end, the business got so overwhelming that I was not able to maintain records and expenses and don't have proper records for the last few months.

    I lost my life with that business and poured my time and all my $$s into and now to spite me, my ex-partner is going after me..

    Should I have my family settle out of court with this guy? I just want to move forward and not risk losing my Chapter 7.

    Any advice would be helpful. If someone can post their email address/phone, I would appreciate it

    I am by no means an expert here but...

    Not knowing the particulars of this debt or the situation with your business makes this a hard question to answer.

    If you do not have facts and documents to take to court and explain your case, you may want to consider settling this matter for 50% and arrange terms that are within your budget. If you ex-partner comes to court with a slew of information and all you have is your word, you may have to pay back the full $5,000. Plus, this objection is now holding up your discharge.

    Just my 2 cents and I am by no means an expert. Since someone called you on the carpet you either have to go an fight to have to pay nothing and risk all or try and settle for half and get this matter over with.
