DH usually gets a small bonus, but this year it was a lot bigger than usual. It will probably go back to being under 1000 again next year. We would like to hold on to it if possible. My lawyer said to get estimates for big things at the house like the roof or braces, but most of those things are okay, and the kids don't need braces. My concern is our old car with 140,000 miles on it that he takes to work and back (40 miles one way). We can use this money to maintain this vehicle since it may or may not make it the remaining 4 yrs and 2 mos of the plan. We already had to cough up almost 1000 to fix it. Has anybody successfully petitioned to keep a bonus? Any advice? We are not behind on our plan, money is tight but livable. thanks.

Depending on your trustee in Michigan, your attorney can exempt the bonus. It might take a few motions with the court etc. While in my plan, my car was not cooperating and my attorney told me to keep the receipts for repairs and then petition the court to keep that portion of my refund etc. I never did it but he told me it was possible and easily done. So I would just petition your trustee to keep the bonus towards the 1000 in repairs already done. Depending on the size, you might want to consider purchasing a back up car with cash just in case. Check with your attorney to see if he thinks your trustee would go along with that plan. My trustee was actually pretty fair.

Thanks, we will try for that and for some dental work. We are only talking about close to 6000, not enough to buy a car or make a big difference to creditors, but a big difference to us! My trustee has been fair also, but we have tried to lay low and just keep paying. This will be the first time that we have filed any kind of motion or anything like that.
