    Length of Plan??

    So I have a question. My plan was written for 36 months. I was told by the attorney it might not fly and I might have to do 60 months it would depend on how they viewed my disability income. I had my 341 hearing today and there was no mention that I would have to lengthen my plan to 60 months. Does this mean I can expect to be in a 36 month plan? The trustee rep went over and had questions about some budget items said we needed to provide proof ..I said ok then he said confirmation date is 2/11. Does it mean after I prove expenses that I can expect a 36 month plan?? FYI--w/o disability on means test we are below median

    If the Trustee had no object to the length of the plan at the time, I would say that the length is what ever your attorney presented. Are you under the median?
    May 2008 Hired 1st Attorney/Stopped paying CCs
    May 21, 2009 Retained 2nd Attorney
    May 28th - Filed for Ch 7 (FINALLY!)
    9/11/09 - DISCHARGED!!!!

      From what I understand, your disability benefits are NOT used in determining your income, only unemployment would be.

      Thus, if you are under the median income, you will receive a MINIMUM of a 36 month plan.

      But, your plan length may vary from 36 to 60 months, which is dependent upon numerous factors.

      What budget items did they want proof for?
